Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Gophee Inc.’s platform, services, website and mobile applications (collectively, the “Platform”). By using Gophee, you agree to these Terms; if you do not agree, you may not use the Platform. Gophee Inc. (“Gophee”, “we”, “our”, “us”) operates an online marketplace that connects users (“Users”) with independent experience providers (“Hosts”) and product vendors (“Vendors”). Gophee does not own, operate or manage the experiences, activities or products listed on the Platform unless clearly indicated.

1. Nature of the Platform

Gophee provides a technology-based platform that enables users to book experiences, activities, workshops, tours and events offered by independent Hosts, purchase locally made or themed products from Vendors, and participate in Gophee’s XP reward system. Unless explicitly stated on a listing, all experiences and products are provided directly by third-party Hosts or Vendors who are solely responsible for the services or goods they offer. When Gophee is the direct provider of an experience or product, this will be clearly stated on the listing page.

2. Eligibility

To use the Platform, you must be at least 18 years old or the age of legal majority in your jurisdiction, or be under 18 and supervised by a parent or guardian who accepts these Terms on your behalf.

3. User Accounts

Some features of the Platform require account creation, and by doing so you agree to provide accurate information, keep your login credentials secure and accept responsibility for all activities occurring under your account. Gophee may suspend or terminate accounts that provide false information or violate these Terms or applicable laws.

4. Bookings and Purchases

When you book an experience, you enter into a direct contract with the Host and Gophee acts only as a facilitating platform; you agree to comply with the Host’s rules, instructions and safety guidelines. When you purchase products, you buy them directly from the Vendor, who is solely responsible for product descriptions, delivery, condition, warranties and fulfillment. Gophee may process payments or facilitate communication but does not assume responsibility for the performance or quality of experiences or products unless explicitly stated.

5. Fees and Payments

Gophee may charge service fees for bookings or purchases, displayed clearly before checkout, and all payments are processed through secure third-party payment providers. Users are responsible for any applicable taxes, customs charges or duties related to their transactions.

6. Cancellations and Refunds

Cancellation and refund policies for experiences and products are presented at checkout. Experience bookings cancelled more than 10 days before the scheduled date are refunded minus a 5% transaction fee, while cancellations within 10 days, no-shows or withdrawals during the activity are non-refundable. Product returns depend on Vendor policies and item condition, with non-returnable items clearly labelled as such; eligible return requests must be submitted within 48 hours of receiving the product. Gophee may assist communication between users and Hosts or Vendors but cannot guarantee outcomes.

7. Platform Conduct Rules

You agree not to engage in unlawful, abusive, harmful or disruptive behaviour on the Platform, including impersonation, posting misleading content, attempting unauthorized access or collecting personal information without consent. Gophee reserves the right to remove content or suspend accounts that violate these terms or affect platform integrity.

8. Gophee’s Role and Limitations

Gophee does not control or guarantee the performance, conduct, safety, reliability or quality of Hosts, Vendors or other users. Gophee is not liable for injuries, losses, dissatisfaction, property damage or delays arising from experiences or products, and participation is undertaken at your own risk. Hosts and Gophee may remove participants who behave inappropriately or compromise safety, without refund.

9. Intellectual Property

All content on the Platform, including branding, design, text, systems, features and certification programs, is the intellectual property of Gophee or its licensors and may not be copied, reproduced or modified without written permission.

10. Privacy

Your personal data is processed according to our Privacy Policy, and by using Gophee you consent to our data practices, including any necessary international transfers to support Platform operations.

11. Termination

Gophee may suspend or terminate your account or access to the Platform if you violate these Terms, if required by law, or if your conduct harms users or the Platform’s integrity. You may close your account at any time by contacting customer support.

12. Waiver of Liability and Assumption of Risk

By participating in any experience or using any product purchased through Gophee, you acknowledge that such activities may involve risks including physical injury, illness, allergic reactions, property damage, emotional distress or unexpected environmental conditions, and you voluntarily assume these risks. You agree that Gophee is not responsible for incidents caused by Hosts, Vendors, other participants, environmental factors or the tools, facilities or materials used. For products, Gophee is not responsible for defects, reactions or damages resulting from items sold by Vendors, who are solely responsible for product accuracy and fulfilment. To the fullest extent permitted by law, Gophee’s total liability shall not exceed the amount you paid for the specific booking or product in question or USD $100, whichever is greater.

13. Disclaimers and Limitation of Liability

The Platform is provided “as is” without warranties of any kind, and Gophee does not guarantee uninterrupted or error-free service. To the extent permitted by law, Gophee is not responsible for indirect, incidental or consequential damages arising from the use of the Platform, and where such exclusions are not allowed, liability is limited to the total amount paid for the relevant booking or purchase.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, unless your jurisdiction requires the application of local consumer protection laws. We encourage users to first contact us for dispute resolution; unresolved matters may be addressed through arbitration or court proceedings depending on applicable laws.

15. Changes to Terms

Gophee may update these Terms periodically, and significant changes will be communicated through email or Platform notices. Continued use of the Platform after such updates indicates acceptance of the revised Terms.

Privacy Policy

Gophee Inc. (“Gophee”, “we”, “us”, “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, share and safeguard your personal information when you access or use our website, mobile applications and related services (“Platform”). By using the Platform, you consent to the practices described in this Policy.

1. Information We Collect

We collect information you provide directly such as your name, contact details, payment information (processed securely by third parties), profile data, booking history and messages, as well as information collected automatically including IP address, device details, usage patterns, cookies and similar technologies. In limited cases and only with consent, we may collect sensitive information such as identity documents for verification or accessibility-related health details.

2. How We Use Your Information

We use your information to operate and improve the Platform, process bookings and payments, personalize recommendations, verify hosts, ensure safety, respond to customer support inquiries, send administrative or marketing messages (when opted in) and comply with legal and regulatory obligations.

3. Legal Basis for Processing

Depending on your jurisdiction, we may process your information based on your consent, the need to perform a contract (such as completing a booking), compliance with legal requirements or our legitimate interests in maintaining security, preventing fraud and improving the Platform.

4. Sharing and Disclosure

We may share your information with service providers who support our operations, Hosts to fulfil your bookings, Vendors to process product orders, authorities when required by law, our affiliates for operational support and potential buyers or investors in connection with corporate transactions.

5. International Transfers

Your information may be transferred and processed outside your country, including in the United States. We take appropriate legal measures, such as standard contractual clauses, to ensure cross-border transfers comply with applicable data protection laws.

6. Cookies and Tracking

We use cookies and similar technologies to remember preferences, measure Platform usage, improve functionality and enable certain features. You may manage or disable cookies through your browser, though doing so may affect your experience on the Platform.

7. Data Retention

We retain your information only for as long as needed to provide services, meet legal requirements or resolve disputes. When no longer required, your data will be securely deleted, anonymized or archived according to applicable laws.

8. Your Rights

You may have rights to access, correct or delete your information, withdraw consent, request data portability, restrict or object to certain processing and lodge complaints with your local data protection authority. Requests may be submitted by contacting us as described below.

9. Children’s Privacy

1The Platform is not intended for children under 13 (or 16 where required by local law). We do not knowingly collect personal information from minors without verified parental consent, and accounts created by minors may be removed.

10. Data Security
We take appropriate technical and organizational measures to safeguard your information, including encryption, secure storage, access controls and periodic security reviews, but no system is completely free of risk and we cannot guarantee absolute security.
