These Terms of Service ("Terms") govern your access to and use of Gophee Inc.'s platform, services, website, and mobile applications (collectively, the "Platform"). By using Gophee, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
Gophee Inc. ("Gophee", "we", "our", or "us") operates a marketplace platform that connects users ("Users") with independent experience providers ("Hosts") and product vendors ("Vendors"). Gophee is not the provider, operator, or owner of the NPC Experiences™, events, tours, or products listed on the Platform.
1. Nature of the Platform Gophee provides a technology-based platform to facilitate: • Booking of NPC Experiences™ and cultural activities designed and operated by independent Hosts • Purchase of locally made or themed products via NPC Market™, sold and fulfilled by Vendors • User participation in XP-based cultural engagement systems Unless explicitly stated on the listing, Gophee does not own, operate, or directly provide the experiences or products offered on the Platform. All services and goods are provided directly by third-party Hosts or Vendors who are solely responsible for them. In cases where Gophee is the direct provider, this will be clearly identified on the listing page.
2. Eligibility To use the Platform, you must be: • At least 18 years old, or the age of majority in your jurisdiction • Able to enter into legally binding contracts • If under 18, supervised by a parent or guardian who accepts these Terms on your behalf
3. User Accounts You may need to create a user account to access certain features. You agree to: • Provide accurate and complete information • Keep your login credentials secure • Be responsible for all activity under your account We reserve the right to suspend or terminate accounts that violate these Terms.
4. Bookings and Purchases a. NPC Experience™ Bookings When you book an experience: • You enter into a direct contract with the Host • Gophee acts only as a facilitator and is not a party to the agreement • You agree to comply with the Host's rules and instructions b. NPC Market™ Purchases When purchasing products: • You buy directly from the Vendor, not Gophee • Delivery times, return conditions, and product warranties are set by the Vendor (subject to Gophee's standard return policy when applicable) • Gophee may facilitate the order and payment but does not assume liability for product quality or fulfillment
5. Fees and Payments • Gophee may charge a platform service fee, disclosed before you confirm a booking or purchase • All payments are processed through secure third-party payment gateways • Users are responsible for any applicable local taxes, customs, or duties
6. Cancellations and Refunds Gophee has standardized cancellation and refund policies for experiences and products, visible at the point of booking or purchase. -Experiences: Cancellations made more than 10 days before the experience will incur a 5% fee. No refund for cancellations within 10 days, no-shows, or after the experience starts. -Products: Return eligibility depends on the product's condition, timing, and vendor policy. If a product listing explicitly states "Non‑returnable," the item cannot be returned. Requests for eligible returns must be made within 48 hours of receiving the item. -Gophee may assist in communication between customers and Hosts/Vendors but does not guarantee resolution or refund outcomes.
7. Platform Conduct Rules You agree not to: • Use the Platform for any unlawful or harmful purpose • Impersonate others or misrepresent your identity • Post harmful, offensive, or misleading content • Interfere with platform systems or attempt unauthorized access • Collect information about other users without consent Gophee may remove content or suspend users who violate these rules.
8. Gophee's Role and Limitations • Gophee does not control or guarantee the conduct, performance, or safety of Hosts or Vendors • Gophee does not verify every claim made by Hosts or Vendors • Gophee is not liable for any injury, loss, damage, delay, or dissatisfaction resulting from the experience or products • Users engage with Hosts or Vendors at their own risk
9. Intellectual Property All intellectual property on the Platform (logos, branding, content, design, NPC Experience™ format, etc.) belongs to Gophee or its licensors. You may not use, reproduce, or modify any content without permission.
10. Privacy Your data is handled according to our Privacy Policy. By using the Platform, you consent to our data practices, including any international data transfers necessary for service delivery.
11. Termination Gophee may suspend or terminate your access if: • You violate these Terms • Required by law or regulatory request • Your conduct harms other users or the platform's integrity You may close your account anytime by contacting support.
12. Waiver of Liability and Assumption of Risk By using the Gophee Platform, you acknowledge and agree to the following: a. Experiences and Activities You understand that participation in any NPC Experience™, activity, or event involves inherent risks, including but not limited to physical injury, illness, property damage, emotional distress, or other unforeseen outcomes. You voluntarily assume all such risks, and to the fullest extent permitted by applicable law, you waive and release Gophee Inc., its officers, employees, agents, and affiliates from any and all liability, claims, demands, damages, or losses arising out of or in connection with: • Injuries or incidents during any experience, whether caused by the Host, other participants, third parties, or your own actions • Conditions of the experience environment, including tools, locations, and weather • Transportation to or from the experience, if applicable Gophee is not responsible for ensuring the safety, licensing, or qualifications of any Host or the conditions of any experience unless explicitly stated otherwise on the listing. b. Products and Goods You agree that Gophee is not liable for any damages, defects, allergic reactions, health issues, or losses arising from the use or consumption of products purchased through the Platform. These are provided solely by independent Vendors. Product descriptions, representations, guarantees, and shipping terms are the responsibility of the Vendor. c. Limitation of Platform Responsibility Except where prohibited by law, Gophee's total liability arising out of or in connection with the Platform or these Terms shall not exceed the greater of: • The total amount paid by you for the specific booking or purchase in question, or • USD $100 Some jurisdictions do not allow the exclusion or limitation of liability for personal injury or fraud, so the above may not apply to you in full.
13. Disclaimers and Limitation of Liability To the fullest extent permitted by law: • Gophee provides the Platform "as is" without warranties of any kind • Gophee disclaims liability for direct or indirect losses arising from use of the Platform, bookings, or purchases • In jurisdictions where exclusions are not allowed, our liability is limited to the amount paid by you for the specific booking or product in question
14. Governing Law and Dispute Resolution This Agreement shall be governed by the laws of the State of Delaware, United States, unless local consumer protection laws in your jurisdiction require otherwise. If a dispute arises, we encourage you to first contact us for resolution. If unresolved, disputes may be resolved through arbitration or court depending on your location and applicable laws.
15. Changes to Terms Gophee may update these Terms from time to time. Material changes will be announced via email or platform notice. Continued use of the Platform after changes constitutes acceptance.
